Under the trademark, as indicated in Art. 1477 of the Civil Code of the Russian Federation, is understood as a designation that ensures the individualization of goods. The description can be verbal or in the form of an image.

In the description of the procurement object, it is allowed to indicate trademark, if there is no other way to clearly state the requirements, in the following cases:

  • with words . In this case, it is necessary to prescribe equivalence criteria in the documentation. In this case, the supplier may offer a product of a different brand, but corresponding to the equivalence indicators. In the application, the participant will indicate the brand and characteristics of his product;
  • incompatibility of products of other brands with the customer's;

If the brand is indicated in the documentation and description of the object and there are no words “or equivalent”, the supplier must supply the goods of the specified brand, the supply of an equivalent product is not allowed.

How to write a technical task

Terms of Reference 223-FZ defines it as one of the parts of the procurement documentation. It contains the basic requirements for purchased GWS. Federal Law No. 44 was issued to regulate contractual relations in the field of public procurement of goods, works, services that are necessary to ensure public and municipal needs.

What contains

Each product, work or service in the catalog has its own specific entry, some of them are combined according to common features and make up an assortment set. Each line consists of the following parts:

  • 21-bit KTR code in public procurement;
  • the name (not trade) of the object of procurement, goods, work or service, indicated without reference to the manufacturer and place of manufacture;
  • unit;
  • description of the characteristics of GWS in accordance with Art. 33 44-FZ;
  • identifiers of all-Russian and international classifications and data on model contracts and their conditions;
  • the date of entry into the list, as well as the moment of its entry into force and expiration.

Each part may also contain the necessary additional specific information about the GWS, their descriptive characteristics, the trade name of the procurement object, price criteria and delivery terms.

When the information for describing the object of the order is agreed between the Ministry of Economic Development, the Ministry of Finance and the Federal Antimonopoly Service, then a specific entry in the GWS list includes the requirements of Art. 33 FZ-44 in part:

  • consumer, technical and operational, qualitative properties of goods, works, services;
  • data on state (national) standards and technical regulations;
  • images - plans, drawings, photographs (as needed);
  • additional information about specific GWS.

How to apply at the planning stage

If the schedule was approved before the date when it is necessary to apply the catalog items, then the information from the catalog can be ignored in the procurement process. But if for the purchase it is necessary to change the schedule, then the characteristics from the catalog must be taken into work according to clauses 7, 9 of the rules for using the catalog of goods, works, services. The rules were approved by Government Decree No. 145 dated February 8, 2017.

From the catalog, you need to take the name of the procurement object and the KTR code when forming the procurement plan. The first digits of the KTR position code in the procurement plan coincide with the first digits of the OKPD 2 code and are included in the procurement identification code (IKZ). When drawing up a schedule, use the units of measurement and the description of the purchase object from the catalog.

In the course of the procurement, use the same information in the notice, procurement documentation and government contract data.

How to work with KRU in 2020

The catalog is being actively updated; as of May 21, 2019, it contains information on more than 58,000 entries. If the product you are purchasing is already in the register, then at all stages of the procurement process you must specify the name, characteristics and other information, as in the catalog for its KTR 2020 code. You cannot correct the data.

If necessary, it can be supplemented, but such actions require justification.

All catalog entries have a date from which all customers must apply the information. This rule is enshrined in clause 10 of Government Decree No. 145 dated February 8, 2017 on the rules for the formation of the KTR.

Paragraph 3 of Government Decree No. 145 states that if the day of mandatory application is still ahead, then you can use the information from the catalog if you wish.

KRU position code - what is it

This is a unique set of numbers. For GRUs that are included in the drug formulary (ESKLP), it consists of 13 digits. Do not confuse with mathematical, in the case of KRU, the discharges are formed according to a different principle. These are some kind of parts of a large code, each can consist of several digits. There are 21 characters in the code.

What is a Catalog and why is it needed?

KRU is a systematized list of all goods, works and services that can be purchased in the interests of state and municipal customers. Law 44-FZ refers to the Catalog in article 23. Part 3 says that on the basis of the names of objects contained in it, an (IKZ) is formed. And in part 6 it is established that the procedure for the formation and maintenance of the KTRU, as well as the rules for its use, are determined by the Government.

The purpose of the KRU is to standardization of names and descriptions purchase items. This means that in the procurement of any customer in all documents related to the purchase of a particular product, it will be named and described in the same way. Thanks to this, any discrepancies and situations are excluded when the description of the object does not fully indicate what exactly the customer wants to purchase.

Registration in ERUZ EIS

How to use the Catalog

  • the date range when the item was included in the catalog;
  • the range of dates when it needs to be applied;
  • OKPD2 code;
  • characteristics (functional, high-quality operational and either technical, as well as consumer properties of the procurement object).

Decree No. 145 mentioned above obliges customers to apply catalog items when preparing procurement documents, namely:

  • procurement plan and schedule;
  • procurement justification forms;
  • purchase notices or invitations to participate in it (for closed methods);
  • procurement documentation;
  • contact;
  • register of contracts;
  • other documents provided by law.

Note! Each catalog item has date from which it must be applied by customers. Until that date, they can use the directory information as they wish.

When generating documents, customers should take the following information from the catalog:

  • name of the procurement object;
  • units;
  • description.

However, in addition to the features and characteristics contained in the catalog, customers may use other elements of the description. But from January 1, 2018, the inclusion of additional characteristics in the documentation must be justified.

Note! Initially, it was assumed that in terms of medicines the catalog would be completed by March 2017, and in terms of other goods and services - by October 2017. However, to date, work on the KTR has not been completed.

Given that the catalog has just begun to fill up, many positions are not yet in it. At the same time, the law obliges the customer to apply the positions of the KTRU, which are already included in it. And in relation to other objects of procurement, you should act as follows:

  • the name and code of the product or service is taken from the OKPD2 classifier;
  • the description of the procurement object shall be drawn up taking into account the norms of Article 33 of Law 44-FZ.

The legislation on the contract system provides for the use by customers to indicate the name of the objects of procurement of a catalog of goods, works, services to meet state and municipal needs (hereinafter referred to as the catalog), which must be placed in the EIS 1. This should unify and standardize the process of generating documents related to procurement, and thereby simplify the activities of customers and help in monitoring and automated control over the implementation of procurement.

At the time of publication of this material, the catalog has not yet been placed in the EIS. At the same time, at the beginning of February 2017, a resolution of the Government of the Russian Federation was issued, which approved the rules for the formation, maintenance and use of the catalog 2 . In this article, we will consider some of the points that are significant for customers, which are contained in this regulatory legal act.

First of all, the normative legal act defines what a directory is. This is a systematized list of goods, works, services purchased to meet state and municipal needs, formed on the basis of the All-Russian classifier of products by type economic activity(OKPD2) OK 034-2014 and includes catalog codes corresponding to specified codes goods, works, services that are the objects of procurement, units of measurement for the quantity of goods, the volume of work performed, services rendered and other information.

Each catalog item includes the following information:

  1. A unique 21-bit directory code.
  2. GRU name (this name is not a trade name, does not contain an indication of a specific manufacturer and (or) place of origin of the goods).
  3. A unit of measurement for the quantity of goods, the volume of work performed, services rendered according to All-Russian classifier units of measurement OK 015-94 (OKEI).
  4. Information containing a description of the GWS (this information is included in the catalog item, provided that the Ministry of Economic Development of the Russian Federation receives the approval of such a description from the Ministry of Finance of the Russian Federation and the Federal Antimonopoly Service).
  5. Reference information: codes corresponding to GWS data according to Russian and international systems classification, cataloging, standardization (if any); information about standard contracts, standard conditions contracts to be applied when purchasing these GWS (if any). This information is subject to inclusion in the corresponding position of the catalog from 01/01/2018.
  6. Date of inclusion in the catalog of the corresponding item.
  7. The start date for mandatory application of the corresponding catalog item. Such a date is set after 30 calendar days from the date of inclusion of the position in the catalog, unless otherwise established by the Ministry of Economic Development of the Russian Federation.
  8. End date for applying the corresponding catalog item.
  9. Additional information: information about the characteristics of a particular product, its manufacturers, trade names, appellations of origin of goods, prices per unit of quantity of goods, volume of work, service and (or) prices per unit of measurement of the quantity of goods, volume of work, service, terms of delivery of goods, performance of specific works, provision of services. This information is generated, among other things, by manufacturers and (or) suppliers (contractors, performers), in relation to medicines, it must be included in the corresponding position of the catalog from 01.03.2017, and in relation to all other GWS - from 01.10.2017.

The position of the catalog is formed for each product, work, service, a separate line of the catalog is formed. But at the same time, several catalog items can be combined into an assortment set, which is understood as a set of catalog items combined according to any one or a combination of signs of goods, works, services.

Thus, the content of the catalog quite voluminously characterizes a particular product, work or service that a customer can purchase. The functioning of the catalog will indeed require the customer only to select the necessary position in it and determine the required volume of purchased GWS.

In accordance with the rules under consideration, the catalog should be used by customers to ensure a uniform indication of the names of GWS in:

  • procurement plan;
  • procurement schedule;
  • forms of substantiation of purchases of GWS during the formation and approval of the procurement plan, procurement schedule;
  • notice of the procurement;
  • an invitation to take part in the selection of a supplier (contractor, performer), carried out in a closed way;
  • procurement documentation;
  • contract;
  • register of contracts concluded by customers;
  • report on the performance of the contract and (or) on the results separate stage its execution;
  • other documents provided for by 44-FZ (for example, protocols of commissions, etc.).

The catalog is also used by customers to describe the objects of procurement, which is included in the procurement schedule, notification of the procurement, invitation and procurement documentation; and generation of a procurement identification code. Recall that the rules for the formation of the procurement identification code provide for the presence in this code of digits, which reflect information about the code of the procurement object according to the catalog (class, subclass, group according to OKPD2) 3 .

Customers have the right to use the information that is included in the catalog item from the date of its inclusion in the catalog. However, from the date of its obligatory application indicated in the catalog item, customers are already obliged to use the information included in the corresponding catalog item when planning the purchase and its implementation, including indicating the name of the product, work, service; units of measure for the quantity of goods, the volume of work performed, services rendered; description of GWS (if there is such a description in the position). Recall that such a date is set after 30 calendar days from the day the position was included in the catalog (see above).

However, the rules allow for a situation where the customer plans and purchases those GWS for which there are no corresponding positions in the catalog. In this case, the customer has the right not to use the catalog, but to describe these GWS in accordance with general requirements to the description of the object of procurement, established in 44-FZ 4 . Customers also have this right when making purchases provided for by the procurement schedule, which is approved before the start date for the mandatory application of the corresponding catalog item (30 days after the item is included in the catalog). However, if changes are made to the procurement schedule in terms of procurement, in respect of the object of which the date for the start of mandatory application of the corresponding catalog item has already come, information on such a purchase in the procurement schedule, the form of procurement justification for it should already be indicated in accordance with the corresponding catalog item .

Thus, the developers of the catalog are not initially tasked with taking into account all possible GWS in it, the purchase of which in practice can be carried out by customers for their various and numerous needs. Consequently, customers should not purchase only those GWS that are included in the catalog. In addition, even if the GWS that are present in the catalog is purchased, the rules allow the customer to indicate in the procurement plan, procurement schedule, procurement justification forms, notification of procurement, invitation and procurement documentation other and (or) Additional information, as well as additional and (or) other consumer properties, including functional, technical, qualitative, operational characteristics of GWS, which are not provided for in the catalog item. But in this case, from January 1, 2018, the customer will have the obligation to include in the description of GWS a justification for the need to use such other or additional information.

Please note that in order to indicate in the procurement plan, procurement schedule and other documents the names of the objects of procurement, the customer has the right to use the names of the assortment sets of goods, works, services (see above). This will avoid unnecessary fragmentation and increase in the volume of documents.

We also note that the catalog should be publicly available around the clock for review and use without charging a fee, and technical support should function for its users using a single federal number " hotline» and e-mail.

It is important that the normative legal act under consideration updated the specific dates for the appearance of the catalog in the EIS and the start of its use by customers. The deadline before which this catalog should finally appear in the EIS is October 1, 2017. Right up to this moment Federal Treasury should carry out the placement in the UIS of the catalog formed by the Ministry of Economic Development of the Russian Federation in the form electronic document, created in common and open formats that provide the ability to save to technical means, search and copy arbitrary text fragments.
